In 1993, with the law 2121\/1993 on copyright and related rights, the state, in harmonization of community and international conventions, instituted the related rights of performers, performers and producers of sound materials.<\/span><\/h4>\r\n[\/vc_column_text][\/vc_column][\/vc_row][\/vc_section][vc_row full_width=”stretch_row” equal_height=”yes” content_placement=”middle” bottom_divider_select=”19″ b_has_animation=”true” b_1_color=”#f8f9fa” b_2_is_gradient=”true” b_2_color=”#c01f3d” b_2_color_2=”#f26c64″ pix_particles_check=”” responsive_css=”{“pix_res_sm_mt“:“10“,“pix_res_sm_mb“:“10“,“pix_res_md_mt“:“20“,“pix_res_md_mb“:“20“}” css=”.vc_custom_1640110860535{margin-top: 80px !important;margin-bottom: 80px !important;}” b_custom_height=”80px”][vc_column width=”7\/12″][vc_column_text]The producers-record companies are natural or legal persons, on whose initiative and responsibility the first recording of a series of sounds is made only. That is, they are the persons who bore the organizational responsibility and investment initiative of the first registration, of the financial risk, of the responsibility of coordination and implementation of the project and they own (or control exclusively) the claim of reasonable remuneration.\r\n\r\nPursuant to Law 2121\/1993, the producer cannot collect individually the rights arising from nos. 18, 49 of Law 2121\/1993, but the collection and management of these rights (relatives) is mandatory by a collective management organization . At the same time, the Grammo Organization receives a fee for specific categories of services arising from no. 47 of Law 2121\/1993. Such services are dubbing and non-interactive online services. The fee for the right of no. 47 from the interactive internet services, such as the services YouTube, Spotify, Deezer, etc., is managed individually by the producers-record companies.\r\n\r\nGrammo was created in July 1994 in the form of a civil non-profit organization, with the aim of collectively managing the related rights of music producers, as set out in Law 2121 of 1993 on “Copyright, Related Rights and Cultural Matters”.\r\n\r\nThe responsibilities of the organization include:<\/strong>\r\n\r\n\u2022 The management and protection of the property right of the beneficiary producers.\r\n\u2022 The collection and distribution of the related right as defined by article 18 and in some cases no. 47 of Law 2121\/1993.\r\n\u2022 The distribution of the collected amounts of no. 49 by GEA to the beneficiary producers-recording companies.\r\n\r\nFor the calculation of the amount to be distributed to the beneficiary-producers, the following factors are taken into account:<\/strong>\r\n\r\n1. Market share\r\n2. Market share of sales of natural products\r\n3. Market share of sales of digital products\r\n4. Frequency of appearance of a registered repertoire of the producer-record company in the official airplay of the radio and television stations.\r\n5. Frequency of appearance of the registered repertoire of the producer-record company in the PLAY-LISTS of music users.\r\n6.
